Texas Democrat James Talarico has spent his U.S. Senate campaign wrapping gun control in the typical anti-gun language about “public safety,” “common ground,” and supposedly protecting the Second Amendment. One direct question cut through that packaging.
In an 18-second television interview clip posted by Lone Star Liberty PAC, Talarico is asked whether he would vote in the Senate for a ban on so-called “assault-style weapons” and “high-capacity” magazines.
His answer is immediate:
“Absolutely.”
When a candidate tells voters that plainly what he intends to do with federal power, gun owners should believe him.

The Campaign’s Second Amendment Language Does Not Match the Answer
Talarico’s official campaign platform claims he would “protect the Second Amendment while protecting our neighbors from gun violence.” The policies beneath that heading include universal background checks, mandatory firearm-storage requirements, and raising the age to purchase certain semiautomatic rifles.
That is already an anti-gun platform. Universal background checks require government control over private transfers if they are to be enforced. Mandatory-storage laws dictate how peaceable citizens may keep defensive firearms in their own homes. Age restrictions deny a constitutional right to adults who may vote, sign contracts, and serve in the military.
But even that platform does not tell the whole story. It does not plainly announce that Talarico would vote for an outright federal ban on firearms and magazines. The video does.
Talarico is willing to use a seat in the United States Senate to prohibit categories of arms and magazines currently possessed by millions of law-abiding Americans.
NRA-ILA: Talarico “Kicked a Hornet’s Nest”
John Commerford, executive director of the National Rifle Association Institute for Legislative Action, released the following statement to AmmoLand:
“By vowing to vote for a so-called assault weapons ban if elected to the Senate, James Talarico just kicked a hornet’s nest. Nearly half of Texas households have guns, and millions of law-abiding Texans own the very rifles and standard-capacity magazines he would ban. Gun owners will decide this election — and Talarico just gave them another reason to vote.”
NRA-ILA issued the statement while conducting what the organization describes as its first national Gun Bus Battleground Tour. The two-month tour is scheduled to cover 13 states and is intended to mobilize gun owners and other Second Amendment supporters ahead of the midterm elections.
These Are Common Arms, Not Political Abstractions
Gun-control politicians use labels such as “assault weapon” and “high-capacity magazine” because the actual objects they want to prohibit are too familiar to demonize honestly.
An AR-15 is a semiautomatic rifle. One trigger function fires one round. A 30-round detachable magazine is standard equipment for the platform. The same is true of magazines holding more than ten rounds for countless commonly owned defensive pistols.
The evidence of common ownership is overwhelming. As AmmoLand previously reported, William English’s 2026 National Firearms Survey estimates that Americans own approximately 40 million AR-15-type rifles and another 20 million comparable semiautomatic rifles.
It also estimates that more than 44 million adults own approximately 539 million magazines holding more than ten rounds. Eighty-eight percent of those magazine owners cited a defensive purpose.
There is nothing “unusual” about arms owned in those numbers. Calling a standard magazine “high capacity” does not make it constitutionally expendable.
The Second Amendment protects the people’s right to keep and bear arms. It does not protect only the firearms a politician considers sporting enough, old enough, or sufficiently underpowered. Nor does it contain an exception allowing Congress to prohibit popular rifles because their appearance resembles military arms.
Talarico Takes the Anti-Gun Side as the Supreme Court Weighs AR-15 Bans
Talarico’s declaration comes at an especially consequential moment. The Supreme Court has scheduled December 2 arguments in Viramontes v. Cook County and Grant v. Higgins, consolidated cases asking whether the Second and Fourteenth Amendments protect the right to possess AR-15s and similar semiautomatic rifles.
The Trump Justice Department is supporting the gun-owner plaintiffs and has told the Court that bans imposed by Cook County and Connecticut are unconstitutional. Twenty-seven states, including Texas, have likewise urged the justices to reject categorical prohibitions on commonly owned semiautomatic rifles.
The en banc Third Circuit recently reached the same essential conclusion when it struck down New Jersey’s semiautomatic-rifle and magazine bans. New Jersey could not produce a historical tradition authorizing government to outlaw arms commonly possessed by peaceable citizens.
That is the constitutional landscape in which Talarico says he would “absolutely” vote for another federal ban.
A Bad Choice for Texas—and a Threat Beyond the State
Talarico’s position should disqualify him with Texans who value the right to keep and bear arms. This is a state where rifles, handguns, and standard-capacity magazines are ordinary tools for defense, ranch and farm use, hunting, competition, and recreation. A candidate seeking to represent Texas in the Senate should understand that reality.
More importantly, a United States senator does not vote only on laws affecting his home state. Talarico would gain a vote on federal legislation governing every gun owner in America. He would vote on judicial nominees, executive-branch confirmations, and national gun-control bills. His hostility to commonly owned arms would not stop at the Texas border.
Talarico will continue using campaign language about “common ground” and “protecting the Second Amendment.” Those phrases cannot be squared with his promise to vote for bans or his stated goals on his campaign website.
The right to keep and bear arms is not protected by allowing citizens to own whatever remains after Washington finishes writing its prohibited-weapons list. “Shall not be infringed” is a command, not an invitation to negotiate over which commonly owned rifle or magazine politicians will target next.
Texas gun owners now have Talarico’s answer. They should remember it when they vote.
By contrast, Ken Paxton has built a documented record of defending Texans’ right to keep and bear arms.
As attorney general, Paxton defended Texas’ campus-carry law against a lawsuit by University of Texas professors, successfully challenged Austin’s attempt to exclude licensed handgun carriers from City Hall, and joined gun-rights organizations in fighting the Biden administration’s rule targeting private firearm sellers, securing a federal court order blocking its enforcement in Texas.
Paxton’s record is more than campaign rhetoric: when federal bureaucrats and hostile local officials have tried to stretch their authority at the expense of lawful gun owners, his office has taken them to court.
The contrast in this Senate race could hardly be sharper. Talarico is promising another vote for banning commonly owned rifles and standard-capacity magazines; Paxton has repeatedly used the power of his office to fight government attacks on the Second Amendment.
Texas gun owners are not choosing between two candidates with minor differences on firearms policy. They are choosing between fundamentally opposing records on the Second Amendment.
